Terms and Conditions
This Agreement is a binding agreement between Autonect and you with respect to your participation (the “User”) in the Services and your consumption of Services through the Autonect Site and Apps. If the User is an Entity, the individual person who accepts this Agreement represents and warrants that he or she is entitled to enter this Agreement as an authorized representative of the Entity and to bind the Entity to the terms of this Agreement.
Given the importance of the terms of this Agreement, we encourage you to study them carefully.
General Terms Applicable to all Users
The User is responsible for maintaining the confidentiality of the User’s account
ID and password and the User accepts responsibility for all activities that occur under the User’s account or password. The User, if an individual, affirms that he or she is competent to understand, enter into, and comply with these Terms and Conditions, and is not under 13 years of age.
Changes to these Terms and Conditions
Autonect reserves the right to make changes to these Terms and Conditions by advising the User of the proposed change using a form of notice that is appropriate for the nature of the proposed change(s), including where appropriate by posting amended Terms and Conditions on the Autonect Site. The changes are effective on the later of (i) the date specified in a notice delivered by Autonect to the User advising of such changes (which message may be delivered by email, messaging, or other electronic means), or (ii) 14 days after the amended Terms and Conditions are posted on the Autonect Site. If the User does not agree to the amended Terms and Conditions, the User may no longer use the Autonect Site or the Services after the effective date of the amendment.
Termination of Access
If the User uses the Autonect Site in any manner that is prohibited by these Terms and Conditions, Autonect may without notice terminate or suspend the User’s use of or access to the Autonect Site or the Services.
Changes to the Autonect Site and Services
Autonect reserves the right to change any aspect of the Autonect Site or the Services including the right to refuse or remove any part of the Site Content, whatever the source, at any time without any notice or liability to the User.
Claims of Infringement
Autonect respects the intellectual property rights of others. If any person believes that his or her work is accessible on or through the Autonect Site in a way that constitutes copyright infringement, please contact Autonect to report copyright infringement.
Upon provision of a notification in accordance herein, Autonect, in its discretion, may suspend access to such allegedly infringing content until resolution of the dispute between the rights holder and the alleged infringer.
Warranties and Liability
The hardware comes with a limited 12 month warranty.
The Services, including the Autonect Site, content and any data or other information provided by the Hardware, software or service, and all server and network components are provided on an “as is” and “as available” basis without any warranties of any kind, and automatic expressly disclaims any and all warranties, whether express or implied, including, but not limited to, the implied warranties of merchantability, title, fitness for a particular purpose, non-infringement, quality, accuracy, timeliness, completeness, correctness or reliability.
Autonect makes no warranty that (i) the Services or Hardware will meet your requirements, (ii) the Services or Hardware will be uninterrupted, timely, secure, virus-free or error-free, (iii) the results (such as vehicle error code analysis) that may be obtained from the use of the Services or Hardware will be accurate or reliable, or (iv) the quality of any services, information, or other material purchased or obtained by you through the service will meet your expectations. No information, advice or services obtained by you from Autonect or through the service shall create any warranty not expressly stated in these terms and conditions. In particular, although Autonect is technically capable of detecting crashes, not all crashes may be detected and Autonect does not guarantee that the service or hardware will detect and/or report all vehicle crashes or that any kind of emergency assistance will be provided in the event of any crash. Autonect is not liable for the actions or inactions of the user, or of any emergency responders or other service providers that may be contacted on your behalf, or for the Service’s inability to contact any emergency responder or other service provider in any particular situation.
Further, the Service does not guarantee that use of the Hardware, software or services will result in any fuel savings or efficiencies or that vehicle error detection will be accurate or error-free. You are solely responsible for safe vehicle operation and proper vehicle maintenance and you should always obtain professional assistance from a vehicle specialist for diagnosis and repair of any errors or other problems with your vehicle.
The User hereby agrees to hold harmless and indemnify Autonect and its officers, directors, employees, consultants, and agents from any and all third party claims, liability, damages, or costs they incur arising as a result of the User’s misuse of the Autonect Site & Services, the User’s violation of these Terms and Conditions, or the User’s infringement of any intellectual property or other right of Autonect or any other person or entity, including such activities that are carried out by any individual using the User’s account ID or password information.
Nothing in these terms & conditions affects your statutory rights as a consumer.
